1. Scope and Enforceability of the Terms and Conditions of Sale
These general terms and conditions of sale define the conditions applicable to purchases made by individuals (hereinafter referred to as "the customer") through the OPcards® website and the company OPcards®. These terms apply exclusively to non-commercial individuals.
Purchasing any product offered on the site implies reading and express acceptance of these general terms and conditions of sale, without requiring a handwritten signature from the customer.
In accordance with current regulations on online contracts, the contract is considered concluded once the customer validates the order by means of a “double-click”, which constitutes an electronic signature with the same legal value between the parties as a handwritten signature.
2. Pricing
Prices are displayed in euros including all taxes (VAT included), based on the applicable VAT rate at the time of the order.
Any change in the applicable VAT rate may be reflected in product prices.
OPcards® reserves the right to modify its prices at any time but guarantees that the price in effect at the time of the order will apply to the customer.
3. Delivery
Delivery is made to the address provided by the customer within the timeframes specified on the website. However, delivery times may vary depending on market saturation, product availability, and the need to place additional orders with our suppliers, particularly in Japan.
If a product is not immediately available for shipment, OPcards® commits to informing customers of any foreseeable delays via email and to providing a revised estimated delivery timeframe.
We make every effort to minimize inconvenience and ensure prompt delivery.
4. Right of Withdrawal
In accordance with applicable legislation on online sales, the customer has the right to withdraw from their purchase within fourteen (14) business days from the date of delivery, without having to provide a reason or bear any costs other than return shipping fees.
Products must be returned in their original condition and complete (including packaging, accessories, manuals, etc.) so they can be resold as new, and must be accompanied by the purchase invoice.
6. Intellectual Property
All elements of the OPcards® website—whether visual, audio, or the underlying technology—are protected by copyright, trademark, or patent law. They are the exclusive property of OPcards®.
Users who operate a personal website and wish to include a simple link redirecting to the OPcards® homepage must request prior authorization from OPcards®.
Any hyperlink using techniques such as framing or in-line linking to redirect to the OPcards® website is strictly prohibited.
In all cases, any authorized link must be removed at the request of OPcards®.
All products and visuals displayed on the OPcards® e-commerce website are replicas of existing products and remain the property of their respective publishers.
7. Legal Information and Privacy
Providing personal information is mandatory for online sales, as it is necessary for processing and delivering orders, issuing invoices, and managing warranty obligations.
Failure to provide this information will result in order cancellation.
In accordance with the French Data Protection Act (Loi "Informatique et Libertés"), the processing of personal data collected during distance selling has been declared to the CNIL (French Data Protection Authority).
Under Article 34 of the Law of January 6, 1978, customers have the right to access, modify, rectify, or delete their personal data by contacting OPcards®.
OPcards® also commits not to disclose customers’ contact details to third parties, either free of charge or for compensation.
